LEX ARCA™ LEGAL VAULT

Ethics & Professional Responsibility Analysis

ABA Model Rules & AI Ethics Standards

How local-first architecture and sovereign vaults fulfill an attorney's mandatory duty of technology competence and client confidentiality.

1. ABA Model Rule 1.1 (Comment 8) — Duty of Technology Competence

"To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology..."

Competence does not mean becoming a software programmer; it requires understanding how an AI tool operates, where its knowledge boundaries lie, and whether its automated outputs have been independently audited against primary legal authorities.

2. ABA Model Rule 1.6(c) & Restatement § 60 — Duty of Confidentiality

"A lawyer shall make reasonable efforts to prevent the inadvertent or unauthorized disclosure of, or unauthorized access to, information relating to the representation of a client."

When an attorney inputs privileged case strategies or client documents into consumer cloud LLMs, those tokens pass through third-party servers, may be stored indefinitely in vendor training logs, and could be subject to discovery or data leaks. LEX ARCA™ solves this by executing AI inferences locally on the attorney's machine.

3. ABA Formal Opinion 512 (July 2024) — Generative AI in Practice

Formal Opinion 512 addresses the full spectrum of generative AI deployment in legal representation, highlighting five crucial duties:

  • Independent Verification: Never rely on AI assertions without reviewing primary court records or statutory reporters.
  • Supervisory Accountability (Rule 5.1/5.3): Partners are strictly responsible for AI outputs deployed in active client matters.
  • Billing Integrity (Rule 1.5): Lawyers cannot bill clients for fictitious time saved by autonomous algorithms.
  • Client Communication (Rule 1.4): When AI plays a central role in strategy or when client data is shared with external vendors, informed consent must be evaluated.
